Preamble

We strongly recommend that you read these Terms and Conditions of Use carefully and in their entirety before using the [sncf-connect-tech.fr] website (hereinafter the 'Site').

The purpose of these Terms and Conditions of Use (hereinafter the 'Terms') is to determine the conditions of access and the rules for use of the Site accessible via the following link: [sncf-connect-tech.fr].

Access to the Site is subject to compliance with the Terms. Access to the Site is strictly reserved to the User as defined in the Terms.

The Publisher reserves the right to unilaterally modify or update the Terms at any time, as changes or additions are made, in particular in order to comply with any legal, jurisprudential, editorial and/or technical developments, as well as any modifications to the terms and conditions of use of the Host's services.

Definitions

In the Terms, words or expressions beginning with a capital letter shall have the following meaning:

Contribution(s): refers to all content that Contributors may publish on the Site.

Publisher: refers to Société Connect & Tech.

Host: refers to SNCF Connect & Tech.

Information(s): refers to all information and publications accessible on the Site.

Site: refers to the site proposed by the Publisher on the Internet at the address www.sncf-connect-tech.fr.

User(s): refers to any person having access to the Site, regardless of their location and connection method.

Contributor(s): refers to all persons having access to the back office with the possibility of publishing content on the Site.

Purpose of the Site

The purpose of the Site is to provide Users with information and assistance concerning all of the Publisher's activities, products, services and offers.

Any use of the Site must comply with the Terms.

Duration of access
 

The User's access to the Site is for an unlimited period, without prejudice to the User's or the Publisher's right to unilaterally terminate this agreement at any time, without notice, reason or compensation.

The User acknowledges that the Publisher may block and/or terminate access to the Site without prior notice and with immediate effect in the event of any breach of statutory provisions and/or the Terms.

Use of the Site is reserved for strictly personal use, except in the case of inserts specified by the Publisher.

In particular, the User agrees, without limitation, not to:

Intellectual property

In general, the User undertakes to not infringe the intellectual property rights (copyright, neighbouring rights, sui generis rights of database producers, trademark rights, domain names, etc.) of the Publisher or Host, or of any third party.
 

The Publisher holds all intellectual property rights to both the structure and content of the Site (text, logos, images, sound elements, software, icons, layout, database, etc.) or has regularly acquired the rights to use the structure and content of the Site, without any limitation.
 

The Publisher grants the User the right to use the Site for strictly private purposes, excluding any commercial use. In the event of professional use, the User must obtain the Publisher's prior express written authorisation.
 

In particular, the User is prohibited from copying, reproducing, representing, modifying and/or exploiting, transferring in any way whatsoever and for any purpose whatsoever, all or part of the structure and content of the Site, except with the Publisher's prior express written authorisation.
 

The Publisher may authorise the User to download certain elements, in particular texts, photographs or music. This feature is at the sole discretion of the Publisher, who may modify or delete it at any time. The User therefore undertakes not to make any claim against the Publisher in this respect. In addition, the Publisher and/or any third party concerned may take appropriate action in the event of an abusive download, particularly in the event of infringement of intellectual property rights.

However, the Publisher reserves the right to object to this authorisation, and accepts no responsibility for the information contained in sites that may be linked to the Site by hypertext or any other means.

In contrast, hypertext links contained on the Site may link to other Internet sites by any means.
 

Insofar as the Publisher cannot control these external sites and sources, the Publisher cannot be held responsible for the availability of these external sites and sources, and cannot accept any responsibility for the content, advertising, products, services or any other material available on or from these external sites or sources.
 

Furthermore, the Publisher cannot be held responsible for any proven or alleged damage arising from or in connection with the use of or reliance on the content, goods or services available on these external sites or sources.
 

Finally, to the extent permitted by law, the Publisher shall not be held liable in the event that the content of said other sites contravenes the legal and regulatory provisions in force.

Personal data protection

Guarantees and liabilities

When using the Site, the User undertakes to not contravene applicable legislative and regulatory provisions, good Internet practice and netiquette, and the Terms.
 

In general, the Publisher declines all responsibility in the event of use of the Site and its services that does not comply with the Terms.
 

The User is hereby informed that any violation of the provisions of the Terms may result in legal proceedings and sanctions being taken against the User.
 

Under the same conditions, the User also undertakes to comply with the internal rules and practices relating to the use of the Publisher's information systems and networks.
 

The User undertakes to act promptly in responding to any claims.
 

The User shall be liable to the Publisher and/or third parties for any direct and/or indirect material or immaterial damage of any nature whatsoever caused by the User and/or their employees in the event of use that does not comply with the Terms.
 

The User guarantees the Publisher, as well as its parent, sister or affiliated companies, its representatives, its employees, its partners, and the Host, against all demands, claims and/or recourse of any kind, resulting from any breach of the said stipulations.
In the event of a dispute arising from a breach of the Terms, the Publisher reserves the right to take action against the User or to call upon the User as guarantor.
 

The User may then be required to indemnify the Publisher, at any time and on first demand, against any damage or against any claim, action or complaint from third parties resulting from any breach of the said stipulations.
 

This guarantee covers both damages and interest that may be paid, whatever their direct or indirect origin, such as lawyer's fees, expert fees and legal fees.
 

The Publisher undertakes to make every effort to implement technical and organisational measures to protect the Information circulating on the Site.
 

Nevertheless, the User declares that they are fully aware that data is not protected against any form of intrusion, including hacking.
 

The User acknowledges that it is impossible to guarantee total security for transmitted data. Consequently, the Publisher cannot be held responsible for any incidents that may arise from such transmission.
 

It is the User's responsibility to take all necessary steps to protect the confidentiality of transmitted data.
 

Each User of the Site expressly undertakes:

  • to not use any software or process intended to copy the Information on the Site without the Publisher's prior express authorisation;
  • to expressly refrain from using software or devices likely to disrupt the proper functioning of the Site, or from taking any action likely to impose a disproportionate burden on the Publisher's infrastructures;
  • to not alter, modify or create derivative works from the Information on the Site without the Publisher's prior express consent;
  • to only use short quotations, analyses and reproductions intended for press reviews or other uses expressly authorised by law within the limits and conditions set by the latter, and subject in particular to citing the names of the authors and the source;
  • to not extract or reuse, including for private purposes, without the Publisher's prior written authorisation, any substantial part of the content of the databases and archives constituted by the Site;
  • to not collect information on third parties, including e-mail addresses, for the purpose of sending commercial or equivalent solicitations, or to integrate them into a referencing service or equivalent, whether free or paid-for, or for the purpose of competitive intelligence;
  • to not set up systems likely or of a nature to hack the Site in whole or in part, or of a nature to violate the Terms;
  • to inform the Publisher as soon as they become aware of any infringement whatsoever (in particular of the Publisher's intellectual property rights), and in particular of any illicit or non-contractual use of the Site's Information, regardless of the means of distribution used.
     

The User who posts a Contribution on the Site acknowledges that they are personally liable, both to third parties and to the Publisher, in the event of infringement of the applicable legislative or regulatory provisions and, consequently, guarantees the Publisher against any disturbance, claim or eviction whatsoever.

Nullity of a clause

The nullity in whole or in part of one or more stipulations of the Terms, under the terms of a legal or regulatory provision or a court decision that has become final, does not entail the nullity of the other stipulations or the part of the provision not affected by the nullity.

Applicable law - Settlement of disputes

The Terms are governed by French law.

In the event of any dispute relating to the interpretation, validity or performance of the Terms, the User and the Publisher agree to use their best efforts to settle the dispute amicably.

In the event of failure to reach an amicable agreement in any dispute arising from the interpretation or performance of the Terms, French courts shall have sole jurisdiction to hear this dispute.
